MODIFICATION OF ARTICLE 2048 OF THE TENTH BOOK OF THE PERUVIAN CIVIL CODE AND REGULATION OF FIRST GRADE RELEASE AS A MECHANISM OF CONFLICT OF LAWS SOLUTION

Abstract

The Peruvian Civil Code dates from 1984, when the context, the actors were typical of that time; from that date until today, much water has owed under the bridge; we live in a different reality, with increasing globalization, development of international relations, frequent international trade which causes problems and the search for solutions to international conflicts, which merits the urgent need to modify article 2048 of the tenth book of our Civil Code, trying to unify ideas with international standards, I propose the regulation of first degree Reenvio as technique of conflict resolution in the matter of Peruvian private international law.
