Fashion law and intellectual property: A strategy utilizing peruvian normative principles

Currently there is a specific section of the law that has experienced a global growth, Fashion Law. Hence, the stylized figures are located in specific seasons, fashion is substantial in the fashion industry and bearing in mind that uniqueness; it is intended to examine the protection that these innovations have similar to what is being done internationally. In this sense, a pure methodology of theoretical analysis is being used, by means of a qualitative approach of explanatory level. Thus, the result shows that in the not too distant future, the fashion industry will enjoy an instrument of laws adjusted to what it requires, instead of turning to other branches privately in the face of judicial dilemmas. To conclude, it will be shown that there is a legal deficiency in the Peruvian legislation, so that an efficient mechanism to acquire such defense through the IP will be proposed.
